Investing in Romania
We know that investing in a foreign country implies many risks for anyone who considers taking such a step. For this reason we could provide you with comprehensive help in all legal and related aspects regarding the two main ways to invest in Romania: running commercial operations and purchasing real estate properties.
1. Running commercial operations
· Any foreign individual or legal person may choose to incorporate a firm in Romania or to buy shares in an existing one. Also, branches of foreign companies may be opened here but they must be registered as any other new company and, in many ways, these branches will be not different from any other firm.
· In principle, there is no limitation to the type of activities that could be performed by a firm, but for some activities special permits are needed. Our firm can provide not only consultancy upon these aspects but representation and/or assistance in getting the necessary permits and licenses.
· Almost all foreign companies choose to have, at least at the beginning of their operations in Romania, the managing team from their country of origin. Since foreign individuals cannot work in Romania unless certain requirements are fulfilled and a work permits is issued by the competent authorities, our firm provides both consultancy and representation for obtaining the work permits.
· One important concern of many companies is the fidelity of their employees and the certainty that the firm’s commercial secrets will be protected at all time. However this objective is difficult to realize in Romania especially since the Labour Code is very protective with the employees.
For this reason, our firm can offer you a Fidelity Agreement to be signed with your Romanian employees, agreement which complies entirely with the Romanian legislation and will offer you the best protection possible.
2. Purchasing real estate properties
· Romania joining the European Union in 2007 has made the purchase of real estate properties in Romania a big opportunity. The most attractive part of such an investment is that for a long time the price of the properties was so low that practically it is impossible to lose money, no real estate property being in danger of decreasing its value.
· Although the Constitution forbids foreigners to buy land in Romania many people from abroad have purchased large parcels of land here through Romanian based companies. The main difficulty is to find the appropriate real estate property and to have the guarantee that the ownership of that parcel is beyond doubt. Since during communism most of real estate properties belonged to the State, the problem is far more complicated than it seems.
· Considering all aspects described above, our firm may offer you not only legal assistance in drafting and verifying the necessary documents, but can help you find the real estate property that you are looking for anywhere in Romania, through our network of affiliated law firms. Also, we can verify the entire background of a property, even offer you a historical overview where available.
